When you make a purchase with us on our Website, we may process limited financial information, such as tokenized credit card details that we may receive from our payment processor. Please note that we utilize a third-party payment processor to facilitate all online payments and if you choose to store your payment information on your account, such information will be stored by the payment processor, not with us directly. 1. Mercier Muses Loyalty Program
When you sign up or join the Mercier Muses Loyalty Program on our Website, we may also collect or otherwise process your birth month and day, your purchase history, reviews that you leave for our products, and other information that can be used to earn points towards rewards. 2. Text An Artist or Live Artistry Support
If you use the “Text An Artist” or “Live Artistry Support” feature on our Website, we will collect certain Personal Information about you, such as your name, email address, telephone number, general geographic location (such as your zip code), facial attributes (e.g., skin type, skin tone, skin shade, etc.), and any other information you choose to voluntarily disclose to us.

The Website may also use Cookies to keep track of items you put into your shopping cart, including when you have abandoned your cart, and this information is used to determine when to send cart reminder messages via text message.

i. The LAURA MERCIER Text Messaging Program
If you have signed up to receive text messages from us, we may collect Personal Information from you through one of our inbound text messaging programs. For example, periodically we may allow customers to send us inbound text messages using a short code that we create and advertise in connection with a special offer or promotion. These programs might be advertised by an independent retailers in their store, or on our Website. We do not disclose mobile telephone numbers with any third parties to use for their own promotional/marketing purposes. We may also keep a copy of your text messages for our business purposes and as needed for any follow-ups.
ii. Live Chat with Customer Care Team

Please note that we sell our products via independent retailers as well. When you purchase our products from an independent retailer, you may be considered that retailer’s customer and not our customer. We do not have actual knowledge that we Sell or Share the Personal Information of Consumers under 18 years of age.

i. Overview
By signing up for the Mercier Muses Loyalty Program, you may be eligible to earn points while you shop and where indicated, to receive special offers from time to time and information about certain sales, promotions, discounts, and coupon codes. We may also offer free samples of our products, free make-overs, and other promotional giveaways. Our Loyalty Program may be considered a financial incentive under the CCPA.
ii. Material Terms
The Mercier Muses Loyalty Program is free to consumers. You will be enrolled in our Mercier Muses Loyalty Program only after you provide prior opt-in consent. Participation in the Mercier Muses Loyalty Program gives consumers the opportunity to accrue points with qualifying purchases that can be redeemed for rewards. As a member of the Mercier Muses Loyalty Program, we may process Identifiers, such as name, email addresses, mailing address, and phone number; your date of birth; your purchase history; and reviews that you leave on our products. The Mercier Muses Loyalty Program is subject to our Terms and Conditions.
iii. How You Can Opt Out
You can opt out of or withdraw from the Mercier Muses Loyalty Program at any time by contacting Customer Service.
iv. The Value of Consumers’ Personal Information
We estimate the value of Personal Information collected through the Mercier Muses Loyalty Program by taking into consideration the anticipated revenue generated from such Personal Information, the value of the free or discounted products or services, the expenses related to offering those products, services, and benefits, the expenses related to the collection, storage, and use of such information in the operation of our business, and other relevant factors related to the estimated value of such information to our business. The financial incentive we offer to Consumers through the Mercier Muses Loyalty Program is reasonably related to the value of the Consumer’s Personal Information.

In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we cannot verify your identity, we will be unable to process your request to know, correct or delete. There may be certain circumstances where we cannot process your request. Authorized agents may also submit requests to us using our Privacy Webform. Before accepting a request from an agent, we will require that any authorized agents verify their authority to act on your behalf. We may also need you to verify your identity directly with us.
h. California Shine the Light Law

X. Children’s Personal Information
Our Website is not made for, intended for, marketed to, or directed at children under the age of 18 years of age. In the event that we learn that the Personal Information of a person under 18 years of age has been collected, we will delete it immediately from our system.
