IF YOU DO NOT UNDERSTAND, ACCEPT AND AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THESE TERMS DO NOT CLICK THE “I AGREE” BUTTON AND WE WILL NOT POST YOUR PHOTO ON OUR WEBSITE.
By clicking on the “I Agree” button you grant us a license to display the photo that you shared with the #lauramercier hashtag (the “Content”) on the lauramercier.com commercial website. Further, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, and fully sublicensable license, under all intellectual property and other rights, including, without limitation, privacy and publicity, to use, distribute, reproduce, modify, adapt, translate, publicly perform, publicly display, transmit, exploit, create derivative works from the Content (in whole or in part), and incorporate the Content into other works in any format or medium now known or later developed, for any purpose, including, without limitation, commercial purposes. You further grant us and our sub-licensees the right to use your name, if we choose. You hereby irrevocably waive any claims based on “moral rights” and similar theories, if any.
By clicking on the “I Agree” button you also represent and warrant that (i) you own or otherwise control all of the rights in and to the Content and have the right and authority to submit the Content and grant us the rights in the Content as set forth herein; (ii) the Content does not infringe, violate, or interfere with any intellectual property or other rights of any third party and does not violate any applicable law or regulation; and (iii) the Content will not cause injury to any person or entity.
